Please share how do you address a privacy violation, by a non-employed physician, found on a random audit?

    Kathy,

Just a question to consider...Why would the employment status of the physician make any difference in your investigation?

Remedies...perhaps, but shouldn't the process be the same?

Investigation is the same. We have a HIPAA Matrix to address action for violations with employees but not non-employed physicians.

    Kathy,

Ahhh, got it. Wish I had more to help you but I don't have experience dealing with physicians.

Medical Staff Bylaws would come into play here and can be used to help guide you in this type of situation.

Ditto to Denise - there should be Medical Staff processes in place to handle misconduct.

I reach out to the head of our Medical Staff Affairs office to see if they want to discuss the matter with the physician and their supervisor or if they would like Privacy to do that. The answer is usually Privacy. If there is a finding we will coordinate with Medical Staff Affairs on a recommendation.
