I have 2 areas I need clarification on if anyone is willing to share:

1.       Can anyone clarify for me the Clearinghouse Requirement to comply with the Privacy Rules. As I read the regs, (and honestly I am confused)  my take away is that BAA's do not have to comply with the Privacy Rules, except with a Clearinghouse. A CE can have a BAA with a clearinghouse, and the Clearinghouse has to comply with the Privacy Rules because they create, receive, send and store PHI??? I know I am not explaining it correctly....confused. Any clarification would be so appreciated.

2.       Marketing Rules with HIPPA – I have read the regs and the Compliance 101 book, and I googled...now really confused!  The more I read, the more confused I get. So, I know you have to have a patients authorization for the disclosure of their PHI, but I am so confused about the direct or indirect remuneration. Does anyone have a simple explanation about Marketing?
