In response to a few questions related to investigation #12 on whether or not a CE is required to send the electronic copy of the EHR in an encrypted manner...the answer is no.
Remember, this is related to Access to PHI and after HITECH...an individual can direct the CE to sent the PHI, or ePHI in this case, in an unencrypted manner. If this is the case, the CE needs to inform the individual of the risk related to sending ePHI in an unencrypted manner as described in the Fed Reg when this was put into place.
