    This section is of particular interest because like some of you, there were stories in the media where people were in hospital EDs that when families called hospitals to find out if their family members were there...people would say "Because of HIPAA...I can neither confirm or deny whether person X is at our facility."  C'mon Man!

    This was probably among the worst "Because of HIPAA" reasons that was commonly used.  As you will hear, such disclosures can be made as explained in 164.510.  What these people should have said more accurately was that such a disclosure was allowed but it was a decision by the CE not to disclose. 

    A classic example where HIPAA gets an undeserved...in my opinion...bad reputation.  So easy for some folks to hide behind the regulations...or who don't read the regulations.

    You said 164.510 was available and in another post that 164.512 was along one so only highlights in podcast, but I don't see either one in the download folder.  Am I missing something?​

    At risk of veering off topic a some, it's my honest opinion that the 'front end' of a lot of provider offices need additional training on HIPAA. I saw a couple of new providers this past year and as part of new hire paperwork just handed me an electronic pen and told me to sign on a platform when it was ready. Giving me almost no information on what I was signing when I asked, just telling me that one of the documents was for HIPAA. It can easily be seen how the average consumer would have no idea what HIPAA entails.

    Glad you shared.   I 100% agree. Had the same experience. And when I ask to see a copy of what I was signing, in one instance, I was given a laminated copy of the documents (heavy verbiage that no one will sit there and read carefully in office) and it was an outdated version (per the staff) that they were updating.  I have wondered if patients can refuse to sign that they recieved or understood the notice and what would that mean/how does that play out in compliance world?

    I also question the practice where when getting a flu shot at chain pharmacies, is it a privacy issue to have customers sign and print their name on a clipboard where you can see other customer names who also got a flu shot from them?

    Wow...the laminated copy deal is crazy...are you to sit there and bottleneck the registration. I think you may get a few dirty looks if you do that.

     

    Just my thoughts, but I would not think that the sign in sheet would be a violation of HIPPA. It only contains the name of the person. Even though it is a given you are there for an immunization...but on the same note,  it is not a violation to put a patients name on a hospital door, or to sign in at the doctor's office. I would think it was fine and no PHI was at risk.

    Thank you for taking the time to create these podcasts Frank.  I have really enjoyed the ones I have been able to catch.  I haven't received any notifications from the group today, but have noted that this string has a lot of responses.  Anyone else getting the silent treatment from email today?
