    3 - illegal to fire a person who reports a problem, however I would also qualify that with who in good faith reports a problem/violation

    I will say, I always have a problem with this one being black and white.  This protection does not necessarily mean that true performance management is not permitted, it just cannot be in retaliation for or related to the complaint and it must be applied equally across the board.  So someone who everyday comes in late and reports something as a whistleblower can still be performance managed for tardiness if that is the standard.
