    Hello,
    Recently, The Compliance Department, has been getting grievances from employees at the direction of HR. Apparently their is an old policy that states that the Compliance Department handles grievances and if we are not able to resolve to the employees satisfaction then  the complaint is escalated to HR. I would like to draft a new policy but before I do I want to check to see if this is standard practice?

    The way we do it is that grievances from employees go to HR first.  If the employee does not feel HR is handling the situation appropriately, then the issue comes to me for review and possible escalation.

    Sometimes I get the HR grievance first from the employee, and if appropriate, I send it on to HR.  Many times we end up working on the situation together until it is determined that HR finish up with a resolution, which may include disciplinary actions.

    Because many of our employee grievances come through our hotline, they are initially logged and farmed out from the compliance office. We send employee grievances to HR as most are "garden variety." However, HR has a set of topics that we work on together should it come up in their investigation. You never know where something is going to go. We had a grievance against the DON for bullying. In the course of investigating the HR stumbled upon a HIPAA concern. Because that was a compliance trigger, compliance then joined in.
