    The scenario is hospital-based. What if we have a patient that had access to the patient portal and access occurred frequently before the patient was deceased. The patient has since expired and the access still occurs. Is there a regulation anywhere prohibiting us from deactivating a patient portal once they are deceased?

    It's my opinion that when you learn a patient is deceased their portal should be deactivated immediately so nobody else can access it.

    Yes, I think the portal needs to be deactivated.

    I'm currently looking for a good article on develop patient portal, can you suggest a detailed article?

    We do have a process for anyone who expires in our acute setting or for those we are notified of in the ambulatory setting. We revoke access to both proxy and patient as we would need updated executorship paperwork if the patient's executor or executrix would want access to the portal. It is completed by the Health Information Management team.

    I agree with Timothy. Our patient portal account is deactivated once the patient is identified as deceased. All medical record requests must go through HIM and meet policy and state requirements for appropriate release.
